Electronic Communications Consent (E-Consent)

This Electronic Communications Consent ("E-Consent") explains your agreement to receive records and communications electronically from Draper Company Ltd. ("Lighter Lending," "we," "us," or "our") and from the Partners with whom we share your request. It is provided under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable state law, and it supplements our Privacy Policy and Terms of Use. Please read it before submitting your information.


1. Your Consent

By submitting your information through lighterlending.com or otherwise using our services, you consent to receive all disclosures, notices, agreements, authorizations, and other communications (collectively, "Communications") from Lighter Lending and from Partners in electronic form, and you agree that we and Partners may conduct business with you electronically.

Electronic Communications may be provided by email, by text message where you have consented to texts, or by posting to the Site. Electronic Communications satisfy any legal requirement that a Communication be provided to you in writing.


2. Scope

This consent applies to all Communications related to your request and our services, which may include account and application updates, privacy and consent disclosures, the Terms of Use, and, from Partners, disclosures required by law such as federal Truth in Lending disclosures, state-specific disclosures, and the terms of any loan or program you may be offered.

Partners may also be required to obtain their own separate electronic consent before providing certain Communications to you. Your consent here is to receive Communications electronically from Lighter Lending and to permit Partners to do the same to the extent permitted by law.


3. Electronic Signature

You agree that your electronic submissions, clicks, and acceptances (including clicking a button indicating agreement) constitute your electronic signature and have the same legal effect as a handwritten signature. You intend the E-SIGN Act to apply to your consent, to the information you provide, and to our and any Partner's ability to conduct business with you electronically.


4. Hardware and Software Requirements

To access and retain electronic Communications, you need:

  • a device with internet access;
  • a current version of a major web browser;
  • a valid email address that you check regularly;
  • if you wish to receive text Communications, a mobile phone capable of receiving SMS; and
  • sufficient storage or the ability to print or save documents (for example, a PDF reader and a printer or storage device).

By providing your consent, you confirm that you can access and retain electronic Communications in these formats.


5. Right to a Paper Copy

You may request a paper copy of any electronic Communication from Lighter Lending by emailing privacy@lighterlending.com. We may charge a reasonable fee for paper copies where permitted by law. Requesting a paper copy does not, by itself, withdraw your consent to receive Communications electronically.


6. Withdrawing Your Consent

You may withdraw your consent to receive Communications electronically at any time by emailing privacy@lighterlending.com with your name and the email address or phone number associated with your request. Withdrawal is effective only after we have a reasonable period to process it and applies only to future Communications.

Because our services are provided electronically, withdrawing your consent may mean we can no longer provide the services to you, and you may need to contact each Partner directly to manage Communications from that Partner.


7. Keeping Your Information Current

You are responsible for keeping your contact information accurate and current. To update the email address or phone number where you receive Communications, contact us at privacy@lighterlending.com. Notify us promptly if you can no longer access Communications at the address you provided.


8. Retention

We recommend that you save or print any electronic Communication you wish to retain. Electronic Communications and electronic records are admissible to the same extent as records originally generated and maintained in printed form.
